Protect The 1st Amendment - Mr. Rooter Wants To Take It Away!

My online petition, Boycott Mr. Rooter's Unethical Business Practices!, is the most concise summary of the injustices inflicted upon myself, my Mother, and the public as a whole.

I am looking for support in order to raise the retainer necessary in order to be able to secure representation and protect my 1st Amendment right to present truthful, accurate, fact-supported information to the public for consideration, in addition to sharing my own opinions and conclusions about the information being provided.

I believe that the Plaintiffs and their lawyer are seeking tort reform - where businesses behaving in a dishonest and unethical manner can successfully sue their victims in court in order to do the following: 1) extort more money from their victims and/or 2) silence one's 1st Amendment right to provide accurate information and share one's opinions and conclusions.

Businesses should NOT be permitted to use the courts to bully their victims into silence to cover up their unethical business practices.  At the same time, consumers should not be permitted to false statements that harm a business' reputation.   

For a $10,000 retainer and a minimum projected estimate of $40,000 to defend, my Mother would have likely been successful in recovering some, if not the full, amount of the three contracts due to the misrepresentation, breach of contract, and property damage; thus, proving my statements are not defamatory.

Unfortunately, Mr. Rooter and their lawyer, John Linkosky, intentionally left the lawsuit lay dormant so that my Mother's statue of limitations would run out.  I believe that if the Allegheny Court of Common Pleas never initated a permanent termination of the suit, then it would still be sitting there....inactive.  

IF MR. ROOTER AND THEIR LAWYER, JOHN LINKOSKY, ARE SUCCESSFUL DUE TO A MISTAKE I MAKE DURING THE PROCESS (NOT AN ISSUE OF MERIT), THEN ALL CONSUMERS WILL LOOSE THEIR RIGHT TO SPEAK OUT AGAINST UNETHICAL BUSINESS PRACTICES AND FORM CONSUMER BOYCOTTS TO PUT PRESSURE ON BUSINESSES TO ACT ETHICALLY.  

Considering my initial experience with Mr. Rooter lasted from December 24, 2011-December 30, 2011, 2 times immediately after work was completed to address sewage backups that the contracted work was supposed to address and didn't, a lie from Robert A. Beall claiming that he was going to address when he returned from Florida where he did not honor his claim, a letter from the lawyer which were based on the lies told by Robert A. Beall and his employees - the ones he sent to our home with guilty pleas of theft (makes perfect sense, though), catching them in the Angie's List false advertising scenerio still an issue today, learning about Robert A. Beall's criminal record for assaulting his neighbor and costing him HomeAdvisor screened and approved status, catching them stealing leads from Mr. Rooter when they called me back as Rooter Champion complete with voicemail and I called the number they called me on as Rooter Champion where they answered as Mr. Rooter, etc...Links to more details can be found at: Boycott Mr. Rooter's Unethical Business Practices!

Above, I have included a YouTube link where, somehow, unpublished reviews were revealed to me when I was on their website and gone after I recorded them; however, it is an example of how corporate claims that they value their customers and are not afraid of dissent; yet, they blatantly ignore both positive and negative reviews received at their website about their Mr. Rooter franchise locations.  They used to moderate them, but now it appears that they don't even bother to approve any comments on their corporate social media sites.  This is an example of intentional, public DECEPTION.  

Support for Jacob

Last weekend, our friend Jacob was arrested following an incident with his family. He is being held in prison on a $100,000 bond and facing some pretty serious charges. I don't know the details of what happened that night, but I do know and love Jacob, and I set up this fund to help him with his legal defense.
Jacob had been doing well lately - he's been working full time building sunrooms for the past 4-5 months and caring for his daughter and her half siblings. But as we know, Jacob is a young man full of potential who comes from a traumatic past. His relationship with his family is extremely complicated and at times a source of great pain. He is dedicated to working on healing from the trauma of his past, but he won't be able to do that sitting in a jail cell for years.
Jacob has been assigned a public defender, but if we know anything about our country's court system, the odds are stacked against young Black men, and public defenders are often overworked and underpaid. Jacob needs someone who can fully invest time and attention in advocating for him. I've been in touch with a lawyer who comes highly recommended by people I trust, and he's willing to offer a discount - but I need some help. I am hoping some of you may be willing/able to pitch in what you can. All money raised will go to Jacob's defense - either to the lawyer (who has agreed to work with Jacob for $3,500) or to commodities Jacob will need as he waits for his trial (in prison, inmates have to purchase basic necessities like soap, deodorant, etc. - and every 15 minute phone call Jacob makes from prison costs him $3).
Please note that I am sharing this with people who know and love Jacob. You can definitely share this with others who may be interested in helping, but in respect for Jacob's privacy, I ask you not to share too broadly/publically.
One bad night shouldn't dictate the rest of Jacob's life. Let's help him get a fair chance at trial.

Return Kortny back to his family so he can continue being a man of God

Kortny is a born again Christian, veteran, father, man of nature, holistic and preventative medicine.  He only began growing cannabis to treat his medicinal needs for PTSD, anxiety, and back pain. He also wanted to provide medical relief for patients such as elderly and cancer sufferers.  
He was arrested sept 12 and charged with a felony for manufacturing a controlled substance which is extracting the medicinal properties from the plant. Another felony for growing cannabis. This is all legal in California where he lives only his public defender refuses to provide his 420 recreational licence and only wishes to convict him. 
He needs a lawyer who will help provide the evidence necessary to get this case dropped. Please help return Kortny to his daughter and fiance who are now homeless due to the circumstances.  This was brought on by their vindictive landlord who also has a 420 rec and was one of his patients. She evicted the whole family due to irradical demands and in attempt to black male him for refusing to help her murder her vegetable husband.  He wishes to leave justice against her in God's hands, but needs to be proven innocent for himself.

A Fighting Chance for Justice

Mr. Timmy A. Beale, a good friend of mine, has been wrongfully accused of rape. He is currently sitting in a cell at the Newport News City jail with no bonds or bail to speak of and desperately needs a lawyer to take his case and prove his innocence. We will need all the help we can get. Please, help us get justice for Tim. 

Whistleblowing - Would You Take the Risk?

My name is Jim Kane, and I am now labeled as a ‘whistleblower.’
Am I proud of my actions? Absolutely!
Has it changed my life? Without a doubt!
Would I do it again? I’m not so sure.
The impact of my decision to blow the whistle on my employer is far greater than I ever expected. As a hardworking man with high standards, a 16-year history with the Armed Services, and a family service legacy that dates back to the founding of the United States, I have always been an advocate of truth and justice. 
However, after I blew the whistle on wrongdoings in my place of employment, it didn’t take long before I acquired the dubious label of ‘whistleblower,’ which as you probably already know, is construed as a ‘troublemaker.’ Leadership immediately began taking steps to silence me and force me into compliance ‘or else.’ I was treated as an outcast – a pariah – instead of recognized for my courage.
What is a whistleblower?
A whistleblower is a person who reports knowledge of illegal activities that occur within an organization. Whistleblowers can be employees, suppliers, contractors, clients or anyone that becomes aware of unlawful activities taking place, generally within their workplace.  (Investopedia)
Whistleblowers are protected from retaliation under various federal programs, but they often face very difficult hurdles to prove what they know. Unfortunately, I can’t give you all the details because my case is still pending – but I will share the basics.
My hope is that your support will help defray my legal expenses as I fight what turned into my wrongful discharge.
Here is what I can tell you:
During the last 18 months of my employment with a large government agency, I filed an Office of Special Counsel complaint regarding prohibited employment practices, an age-based EEO complaint, and a fraud, waste, and abuse complaint with the Inspector General. These filings were highly credible and were based on activities that represented one or more of the following legal violations:
  • Gross mismanagement: substantial risk of significant adverse impact on mission
  • Gross waste of funds: more than a debatable expenditure
  • Abuse of authority: an arbitrary decision for personal gain and/or to injure others
  • A substantial and specific danger to public health or safety
According to the Equal Employment Opportunity Commission (EEOC), the law forbids retaliation when it comes to any aspect of employment (including hiring, firing, pay, job assignments, promotions, layoff, training, fringe benefits, and any other term or condition of employment).
However, despite my 16-year career of good performance, no previous disciplinary actions, and over 30 years in the industry of design and construction, the agency’s leadership quickly removed me from service within a few months of my filings and just two months after another acceptable year of service as stated in my annual review.
In the end, even when I agreed to comply with the conditions they set before me, they decided to remove me anyway with a different charge leveled on me at the last minute with no due-process. The bottom line is  they were all aware of these protected "whistleblower" activities, and on November 25, 2015, I was fired from federal service after taking a stand against what I believe were unlawful acts of fraud, waste, and abuse  within a government agency.
My 16-year career of good performance and no previous disciplinary actions meant nothing, and my reputation was destroyed.
After they removed me from my job, I had 30 days to file an appeal. In December 2015, I hired an attorney, and we filed my appeal through the Merit System Protection Board (MSPB). The MSPB accepted my appeal, and my hearing was completed in April 2016.
This appeal process has already cost me my life's savings and has created much hardship for my family and me. I have exhausted all my cash reserves, sought work without success, and am now faced with an attorney's fee of more than $65,000.
The Whistleblower Protection Act of 1989 was enacted to protect federal workers who report misconduct in the government. However, despite that, it’s not easy road for a whistleblower.
2011 National Business Ethics Survey titled ‘Retaliation: When Whistleblowers Become Victims.’ The report contains some shocking statistics:
  • 45% of US workers observed wrongdoing;
  • 65% of those who witnessed wrongdoing reported it;
  • 22% of those who reported wrongdoing said they experienced retaliation (an increase of 46% from 2009); and
  • 46% of those who observed wrongdoing but chose not to report it, cited fear of retaliation as the reason.
I've found out the hard way that whistleblowing is much harder than simply identifying a problem and going to the authorities for help. It is expensive! I’ve also learned that it’s difficult for a man who is nearly 60 to find a job, especially when he was fired from a federal job.
I need your help as I stand up against a bureaucratic Goliath!!

Wicked ex step Mother

Hello my name is Donna. My father passed away November 5th 2015. I am his first child from his first marriage. I also have a half sister named Cynthia. My father was divorced from Cynthia's mother in 1982. They continued to live together until my fathers death. After that she attempted to evict my sister from the house that was bought for her in 1984. She has lied about their marital status on all legal documents(death certificate) she has harassed Cynthia and made her life hell. I recently moved in with my sister due to husband dieing and being left homeless. We lived in families building. We recently consulted a lawyer and he said we have an easy case to win. My sister works for the post office but has been strapped with bills. We need $1000 by end of week. His will is in probate so time is of the essence. Neither one of us received notification of the probate in time.
