Terry is another victim of the United States "justice" system. He is an innocent man serving a life sentence for a crime that was proven, in court, that he did not commit. His conviction was SOLELY based on lies told by co-defendants who made deals with the District Attorneys' office for reduced sentences. They have all - since - recanted and told the truth how they were "rail-roaded" and threatened by the District Attorney's office.

As a matter of fact, Terry was in a tavern on the other side of town at the time of the crimes being committed. And, prior to Terry's trail, Prior to defendant's trial, the REAL murders - Arnsperger and Mathis - both pleaded guilty to felony murder for the crimes committed.

According to filed court records, the REAL murderers - Arnperger and Mathis - were seriously impeached by prior inconsistent statements they had made to the police at the time the crime was being investigated. Mathis in particular admitted that he had lied to the police in an attempt to minimize his responsibility for the crime.

The murder weapon was never found, and no physical evidence linked Terry to the crime. According to filed court records, Terry's conviction rested primarily on the testimony of Arnsperger and Mathis. Sadly, Terry did not present any evidence at the trial and did not testify in his own behalf to clear his name. Consequently, Terry's trail attorney allowed him to be placed in the position to be convicted by an UNINFORMED jury - a travesty that is VERY common now in our courts.

According to court records, the evidence presented at the trial showed beyond a reasonable doubt that Terry could not have been guilty nor was he at the scene of the crime.

The court documents' filed argues that the jury's general verdict against Terry may have rested exclusively on the improper felony murder ground and that such a charge, and the instructions based thereon, are unconstitutional - which should have never been ruled upon; therefore, Terry should have NEVER been found guilty.

The court records also filed clearly states that evidence in Terry's case was not closely balanced. Although there was no physical evidence linking Terry to the crime, the testimony of Arnsperger and Mathis, though impeached by prior inconsistent statements made to the police during the course of the investigation, was unrebutted.

Finally, the court has since found that Terry received ineffective assistance of counsel at his trial with respect to 13 enumerated points, which include those claims of error already discussed herein. There is no doubt that Terry trial counsel did make mistakes at his trial. THIS CASE AGAINST TERRY IS A TOTAL MISCARRIAGE OF JUSTICE!
