AGENT: The Smartwatch that Never Was



The AGENT Smartwatch project is a Kickstarter "crowd-funded" project which can be found here. The Kickstarter project was created and administered by Chris Walker of Secret Labs LLC, who has acted as project creator and the manager of various sub-contractors and employees. The project met and substantially exceeded its funding goal on Jun 20, 2013 by attracting $1,012,742 from 5,685 backers. The project was due to deliver rewards to backers by December 2013.
Under the Kickstarter Terms of Service in force at the time the AGENT SmartWatch project was initiated and funded, the creator of the project must deliver either promised rewards, or provide refunds to backers.
While it is not uncommon for Kickstarter projects to run behind schedule, the AGENT smartwatch is a particularly egregious example, and the actions of the project's creator/project manager now demand forceful action. The project is now two years overdue with no timeline or even evidence of positive progress toward refunds or the delivery of promised rewards. The creator/project manager appears to be engaging in stalling tactics for the purpose of denying backers their rights under the Kickstarter Terms of Service.
This Funded Justice campaign aims to collect enough funds to hire competent legal representation and potentially initiate a class action on behalf of willing and eligible backers in satisfaction of the agreed terms of the AGENT project. The exact form of any action taken will depend upon legal advice obtained from the legal counsel hired with the collected funds.
If you are a backer of the AGENT smartwatch, or you just care about accountability in crowd-funded projects, I call on you to support this Funded Justice effort in whatever amount you can so that this and future crowd-funded projects know with certainty that they must be accountable to their backers or suffer meaningful consequences.
