Free Will

My (now) 21 year old son was arrested on April 7, 2016 and has been charged with 4 felony charges related to possession of and distributing child pornograpgy. To read his charges, he sounds like a perverted child molester but those who know him know the truth. He has never been in trouble for anything! He engaged in a "relationship" with 17 year old girl (she turned 18 in June) he'd gone to high school with. She'd sent him some inappropriate photos via text message that he had on his phone. While attending vocational school, he plugged his phone in to the school computer to charge his phone and it automatically synced the photos to the computer. He in no way intentionally downloaded them. The law in Oklahoma states that it's legal for a teenager over the age of 16 to consent to and have sex with someone over 18, but it is illegal for an adult possessing a photograph (even if the subject is above consenting age).  Will has severe asthma and as the result of a severe asthma attack when he was 14 (he coded and was without oxygen for a significant amount of time, causing some brain damage) he has some cognitive deficiencies and still has severe issues with his asthma. From the time he was arrested to now, his maintenance medication had been withheld on more than one occasion and his requests to see a physician have been denied. His health is a great concern as a result. His bond was set at $100,000 and as a single mother I do not have the means to post bail or the $1,200 psych evaluation that we are required to pay in order to have the DA review and possibly reduce the final sentencing. His next court date is not until February 14, 2017 and due to his medical issues, it is detrimental to his health not to be out and able to seek proper medical treatment.
